Wird ein <\/span><b>Pkw von Privatperson zu Privatperson verkauft<\/b><span style=\"font-weight: 400;\">, kann der Vertrag auch m\u00fcndlich abgeschlossen werden. Allerdings ist die Beweisf\u00fchrung im Schadensfall nur schwer m\u00f6glich, wenn es keine schriftliche Fixierung des Kaufs gibt. Schlie\u00dflich gibt es auf dem Neuwagenmarkt keine privaten, sondern ausschlie\u00dflich kommerzielle Verk\u00e4ufer. Es kommen dabei in der Regel standardisierte Kaufvertr\u00e4ge zum Einsatz. Diesen liegen\u00a0 die sogenannten Neuwagenverkaufsbedingungen (NWVB) zugrunde. Dieses schreibt in <\/span><b>\u00a7 433<\/b><span style=\"font-weight: 400;\"> f\u00fcr den Abschluss eines Kaufvertrags vor, dass sich der Verk\u00e4ufer dazu verpflichtet, dem K\u00e4ufer die jeweilige Kaufsache zu \u00fcberlassen. Zudem muss das Kaufobjekt frei von Sachm\u00e4ngeln sein. In unserem Beitrag \u201c<\/span><span style=\"font-weight: 400;\">Sachm\u00e4ngelhaftung beim Auto<\/span><span style=\"font-weight: 400;\">\u201d finden Sie weitergehende Hinweise und Tipps zu diesem Thema. \u201cFrei von Sachm\u00e4ngeln\u201d bedeutet \u00fcbrigens nicht, dass es nicht besch\u00e4digt sein darf. Dies w\u00e4re bei einem Gebrauchsgegenstand wie einem Auto ohnehin nur schwer zu erzielen. Dazu macht <\/span><b>\u00a7 434<\/b><span style=\"font-weight: 400;\"> weitere Angaben. Dieser sagt aus, dass etwaige Sch\u00e4den transparent gemacht werden m\u00fcssen. Der Verk\u00e4ufer darf sie dem K\u00e4ufer also nicht verheimlichen. Werden bekannte M\u00e4ngel wissentlich verschwiegen, kann arglistige T\u00e4uschung vorliegen. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Laut BGB ist allerdings nicht nur der Verk\u00e4ufer gegen\u00fcber dem K\u00e4ufer in der Pflicht. Damit ein Vertrag ordnungsgem\u00e4\u00df geschlossen wird, muss der K\u00e4ufer den vereinbarten Kaufpreis \u00fcbergeben. Erst wenn diese Anforderungen erf\u00fcllt sind, sollte der angefertigte Kaufvertrag beiderseits unterschrieben werden. Dazu k\u00f6nnen Klauseln wie <\/span><i><span style=\"font-weight: 400;\">\u201eAuto gekauft wie gesehen\u201c <\/span><\/i><span style=\"font-weight: 400;\">oder inhaltlich identische Anmerkungen im Kaufvertrag notiert werden. So l\u00e4sst sich verhindern, dass der Verk\u00e4ufer eine <\/span><b>Gew\u00e4hrleistung f\u00fcr offensichtliche M\u00e4ngel<\/b><span style=\"font-weight: 400;\"> \u00fcbernehmen muss. Versteckte M\u00e4ngel m\u00fcssen dennoch ausgebessert werden. Die Klausel bedeutet somit nicht, dass ein Verk\u00e4ufer einem K\u00e4ufer ein schadhaftes Fahrzeug \u201eunterjubeln\u201c kann. Waren dem Besitzer bereits vor dem Kauf m\u00f6gliche Sch\u00e4den und M\u00e4ngel bekannt, so muss er diese beim Kauf offenlegen. Ansonsten kann ihm ein <\/span><b>arglistiges Verhalten<\/b><span style=\"font-weight: 400;\"> unterstellt werden. Die in der Regel sehr <\/span><b>schwierige Beweisf\u00fchrung<\/b><span style=\"font-weight: 400;\"> daf\u00fcr liegt jedoch beim K\u00e4ufer.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Handelt es sich um einen professionellen Verk\u00e4ufer, so ist diese <\/span><b>Klausel wirkungslos<\/b><span style=\"font-weight: 400;\">. Selbst dann, wenn sie im Kaufvertrag erw\u00e4hnt sein sollte. Einem H\u00e4ndler wird ein umfangreiches Know-how zugesprochen, das \u00fcber das von Privatpersonen hinausgeht. Er muss damit zumindest <\/span><b>im ersten Jahr nach dem Kauf<\/b><span style=\"font-weight: 400;\"> f\u00fcr auftretende Sch\u00e4den haften oder beweisen, dass diese beim Kauf noch nicht existierten. Ausgenommen davon sind nur offensichtliche M\u00e4ngel, die der Kunde beim Kau<\/span><\/p>\n<\/div><\/section><\/div><div class=\"flex_column av_one_half  flex_column_div av-zero-column-padding   avia-builder-el-20  el_after_av_one_half  avia-builder-el-last  \" style='border-radius:0px; '><section class=\"av_textblock_section \"  itemscope=\"itemscope\" itemtype=\"https:\/\/schema.org\/BlogPosting\" itemprop=\"blogPost\" ><div class='avia_textblock  '   itemprop=\"text\" ><h2 class=\"title\" style=\"text-align: left;\">Tipps<br \/>\n<strong>f\u00fcr private Verk\u00e4ufer<\/strong><\/h2>\n<p style=\"text-align: left;\"><span style=\"font-weight: 400;\">Private Verk\u00e4ufer k\u00f6nnen sich im Internet problemlos ein <\/span><b>Muster eines Kfz-Kaufvertrags<\/b><span style=\"font-weight: 400;\"> herunterladen und verwenden. Diese werden unter anderem von Versicherungen und den gro\u00dfen Automobilclubs bereitgestellt. Wer eine solche Vorlage verwendet, kann sicher sein, dass alle <\/span><b>relevanten Vertragspunkte abgedeckt<\/b><span style=\"font-weight: 400;\"> werden. Wichtig ist, dabei unter anderem auch die Personalausweisnummer des K\u00e4ufers zu notieren. Das schafft Sicherheit und sorgt im Fall der F\u00e4lle f\u00fcr eine eindeutige Zuordnung.
